This website is provided by CausePilot, a product of Common Good Fundraising LLC and its fundraiser customers (collectively, “CausePilot”). By accessing the CausePilot website (the “Site”), you are indicating your acknowledgement and acceptance of these Terms of Use (“UTOS”). These UTOS are subject to change by CausePilot at any time in its discretion. Your use of this Site after such changes are implemented constitutes your acknowledgement and acceptance of the changes. Please consult these UTOU regularly.

THIS AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU, CAUSEPILOT, ITS FUNDRAISER CUSTOMERS AND GOVERNS YOUR USE OF THE SERVICES. BY USING THE SERVICES YOU ARE INDICATING THAT YOU HAVE READ AND AGREE TO THESE TERMS OF USE AND CAUSEPILOT’ PRIVACY POLICY (“PRIVACY POLICY”) AND ANY OTHER RELATED TERMS, GUIDELINES, RULES, AND CONDITIONS LOCATED ON CAUSEPILOT’ WEBSITES, ALL OF WHICH ARE INCORPORATED HEREIN BY THIS REFERENCE. IF YOU DO NOT AGREE TO THESE UTOS, DO NOT USE THE SERVICES. In the event any of the terms of these UTOS conflict with the Privacy Policy or the Fundraiser Terms of Service (“FTOS”), the terms of the Privacy Policy and UTOS shall govern as to the conflicting terms. DESCRIPTION OF SERVICE

Unless explicitly stated otherwise, any new features that augment or enhance the current Site, including new releases, shall be subject to these or other applicable TOU. You also understand and acknowledge that CausePilot may modify, terminate, suspend, or otherwise adjust any and all functions, features, options, utilities, tools or other aspects of the Site at any time without prior notice to you. You understand and agree that the Site is provided “AS-IS” and that CausePilot assumes no responsibility for, among other things, availability, timeliness, deletion, failure to store any user data or communications or personalization settings, or changes to the Site CausePilot may make from time to time. You are responsible for obtaining access to the Site, and that access may involve third-party fees (such as Internet service provider or airtime charges). In addition, you must provide and are responsible for all equipment, third party software, and updates necessary to access the Site.

All fundraising campaigns and events are chosen, operated, and managed by a Fundraiser customer (“Fundraiser”) of CausePilot. All product information, photos, and information are posted directly by the Fundraiser.

The term ‘CausePilot’ or ‘us’ or ‘we’ refers to the owner of the website whose mailing address is P.O. Box 50554, Nashville, TN 37205. The term ‘you’ refers to the user or viewer of our website. The term ‘Fundraiser’ refers to the customer and its administrators, managers, or committee members hosting a campaign or event using the Site and software services provided by CausePilot. The term ‘participants’ refers to the users taking part in a fundraising campaign or event through donating, buying, sponsoring, advertising, bidding, or any other viewing or purchasing.

The content of the pages of this Site are for your general information and use only. It is subject to change without notice.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, presentation, completeness or suitability of the information and materials found or offered on this Site for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we fully and expressly exclude liability for any such inaccuracies or errors.

Your use of any information or materials on this Site is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this Site meet your specific requirements.

You acknowledge, and understand, that CausePilot is not the owner of any items or materials you may purchase from a campaign or event and that all monies paid through the Site, excluding CausePilot Service Fees and Payment Processing Fees, are transferred to the Fundraiser. Once those funds are transferred, your only recourse for refunds, or changes in any way to the transaction, are with the Fundraiser.

This Site contains material which is owned by or licensed to us. This material includes, but is not limited to the design, layout, look, appearance and graphics. Except as may be contemplated by these terms and conditions, reproduction is prohibited.

Unauthorized or inappropriate use of this Site may give rise to a claim for damages by us or a third party and/or be a criminal offense.

From time to time this Site may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for any aspect of the content of the linked website(s).

Your use of this Site and any dispute arising out of such use of the Site is subject to the local laws of the State of Tennessee, USA, without regard to the choice of law rules of such State.

CausePilot values and respects the intellectual property and other rights of third party creators and content owners, and expects you to do the same. You therefore agree that any User Content that you enter or upload to the Site does not and will not violate any law or infringe upon the rights of any third party, including without limitation to any intellectual property rights, copyrights, publicity rights or rights of privacy. We reserve the right, but are not obligated, to remove User Content from the Site for any reason, including User Content that we believe violates these Terms. It is important that you understand that you are in the best position to know if the materials you post are legally allowed. We therefore require that you exercise diligence and care appropriate under the circumstances when deciding what photos and content you upload and make available for viewing on our Site, including, without limitation, email addresses.

PARTICIPANTS: 

By agreeing to these terms and conditions, users warrant that:

You are 18 years of age or older and can legally enter into a binding contract.

Visiting or participating in a campaign or event, while logged into CausePilot, will add your information and activities to the Fundraiser’s contact list of participating users.

You understand that all payments must be submitted by you, in your name, using your credit card or other form of payment.  You, as the User, will receive all payment receipts.  Not the user, only the payer, may use any potential tax deductions.  If someone other than you submits payment you may not use the payment receipt for the purposes of tax deductions.

You have any required permission(s) from your company to use its name, seal, logo, or any other materials rightly owned by it for the purposes of your activity on our site.

You have read, understand, and acknowledge our Guidelines, Rules, and Terms of Use prior to entering into any donating, buying, or bidding on the Site.  Auction Rules may be viewed here: https://causepilot.freshdesk.com/support/home.

You understand a portion of the proceeds from the campaigns and events available through the Site will pay for the services provided by CausePilot and applicable Payment Processing.  Fundraisers have the option to ask Users and Participants to contribute to these costs.  By using this site, bidding, or buying products and services offered by the Fundraiser, if this option is exercised, you will be liable for these fees.

You indemnify and hold harmless CausePilot, a product of Common Good Fundraising LLC, from any and all claims for damages, losses or liabilities arising from your negligent or willful acts, errors or omissions, or from the breach by you of the terms of this Agreement.

New features and improvements to this software may be in beta testing.
